General Terms & Conditions

1. Definitions

  • Brand: USHBA, located in the Netherlands, registered with the Chamber of Commerce (KvK) under number 42005811.
  • Customer: Any natural person or legal entity entering into an agreement with USHBA.
  • Products: All outdoor apparel, gear, and accessories offered by USHBA.

2. Applicability

These General Terms & Conditions apply to all offers, orders, and agreements between USHBA and the Customer. By placing an order via our website, you explicitly acknowledge and agree to these terms.

3. Offers and Pricing

  • All prices are listed in Euros (€) and include Dutch VAT (NL005433444B75) unless otherwise stated.
  • Shipping costs are not included in the product price and will be calculated during the checkout process.
  • USHBA is not bound by obvious errors or mistakes in the offer (e.g., pricing errors due to technical glitches).

4. Payments

We accept various payment methods as indicated on our website. Orders will only be processed and shipped once payment has been successfully received.

5. Shipping and Delivery

  • We strive to process and ship orders as quickly as possible. Estimated delivery times are indicative and not guaranteed.
  • Risk of loss or damage to the products passes to the Customer at the moment of delivery to the specified address.

6. Right of Withdrawal (Returns)

  • The Customer has the right to retract the purchase within 14 days of receipt without providing a reason.
  • Conditions: Products must be returned in their original, unused condition, including all original packaging and tags. For hygiene and safety reasons, gear that shows signs of outdoor use, dirt, or wear cannot be accepted for return.
  • Return shipping costs are the sole responsibility of the Customer.

7. Warranty and Maintenance

  • USHBA warrants that products meet the reasonable requirements of reliability and usability.
  • Warranty does not cover defects caused by “fair wear and tear,” improper maintenance (e.g., not following technical washing instructions), or accidental damage.

8. Outdoor Safety Disclaimer

  • Hiking, climbing, and outdoor activities are inherently dangerous.
  • Liability: USHBA is not liable for any direct or indirect injury, physical harm, loss, or damage sustained by the Customer or third parties while using our products. The Customer is responsible for having the necessary skills, gear knowledge, and safety awareness required for their activities.

9. Privacy

Your personal data is handled with care in accordance with the GDPR (AVG). Please refer to our Privacy Policy for more details.

10. Governing Law

These terms and any disputes arising from them are exclusively governed by Dutch Law. All disputes shall be submitted to the competent court in the district where USHBA is established.
